TERMS & CONDITIONS

ACCEPTANCE OF TERMS

Your access to and use ofwww.caffeprima.co.uk, ("The Website") which is owned and operated by Primo Water t/a Caffé Prima(hereinafter referred to as Caffé Prima) or any other affiliated site that is run by or linking to Caffé Prima is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions.

By continuing to use the Website to browse or order from Caffé Prima, you fully accept the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions, you must immediately stop using the Website and discontinue purchasing from Caffé Primain any form.

ADVICE

The contents of the Website, or any verbal communication from Caffé Primadoes not constitute advice and should not be relied upon in making or refraining from making any decision. 

General information or technical guidance relating to products is sourced externally. Caffé Prima will always endeavour to keep such information up to date, accurate and reliable.

CHANGES TO WEBSITE

Caffé Prima reserves the right to change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Caffé Prima shall not be liable to you for any such change or removal; and change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed your acceptance of such change.  It is your responsibility to review these terms and conditions periodically to ensure you are aware of any changes that may affect you.

MAILING LIST SUBSCRIPTIONS

By maintaining your subscription on the Website by opting in, you agree to receive regular communications and promotions from Caffé Prima. Caffé Prima will never sell, provide or disclose your personal information to a third party. You can unsubscribe or manage your subscription preferences in your ‘my account’ area.  

If you choose to unsubscribe completely and remove your email from Caffé Prima databases, you will need to send an email to enquiries@caffeprima.co.uk to notify Caffé Prima of your wishes.

PLACING ORDERS

Caffé Prima will endeavour to ensure that any priced item on the Website is available for delivery as per the notified date on the Website.

Caffé Prima will offer bulk discounts on some product lines and prices will be automatically calculated when choosing the product quantity. Quantities can be adjusted by you when adding products to the basket or when viewing your basket at checkout.

ONLINE SECURITY

Caffé Prima places an extremely high level of importance on security and internet fraud.

Caffé Prima makes every effort to ensure all orders received via the Website are thoroughly checked using the information supplied at the time of placing the order.

However, there is the possibility that we may need to contact you to make further security checks. We ask your co-operation to allow us to complete these check as quickly and efficiently as possible. Fraudulent activity and attempted transactions are not tolerated by us, and are immediately reported to the relevant authorities.

Caffé Prima use a secure checkout facility on the Website. Caffé Prima appreciates that it may take a few moments longer to complete the security process during transactions but the majority of our customers prefer security over speed. Caffé Prima does not see or store your payment details.  Only the final transaction detail and method of payment is visible to Caffé Prima.

In the absence of negligence on the part of Caffé Prima, we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the Website.

If your online identity has been stolen and your cards are being used fraudulently to purchase goods from the Website, on discovery and on your behalf Caffé Prima will inform the relevant authorities.

OWNERSHIP

All goods purchased from the Website remain the property of Caffé Prima until paid for in full and cleared. 

DELIVERY TIMES

Standard orders or orders eligible for free next day delivery must be placed before 3pm for same day shipping and next day delivery. Order placed after 3pm will be shipped the following day.

Caffé Prima cannot guaranteenext working day delivery and will not under any circumstance compensate for said non delivery.  

DELIVERY CHARGES

Delivery charges are calculated from the total price of the all items ordered; this is automatically calculated in the shopping cart for you. Please visit our Orders, Deliveries and Returns page to learn more.

Please Note: additional delivery charges apply for delivery to the Channel isles or Scottish Isles, Northern Ireland, Ireland & Scottish borders. There may also be an additional delivery charge applied for preferential shipping requirements (i.e. before 12 noon or Saturday delivery)

ORDER ENQUIRIES

Contact us here RETURNING NON-FAULTY GOODS

Should you wish to return goods which have been ordered incorrectly or classed as non-faulty, we will accept requests returns up to 14 days after you have received the goods (for reference received time for the goods starts from the date you have signed for the goods (signature from courier service is recorded for reference). 

We reserve the right not to refund items that are returned in unusable or unsellable condition, (e.g. – damaged after delivery).

PLEASE NOTE: The cost and responsibility of returning non faulty or unwanted goods will be the responsibility of the customer. We will only issue any agreed refund once the returned goods are received by us and we have agreed that the goods and packaging are in a satisfactory re-sellable condition and have not been used.

Whilst we will make every attempt to remedy this type of situation, we must emphasise it is everyone's interest to ensure the correct items are being ordered and are suited for your particular requirements. 

GOODS DAMAGED IN TRANSIT

If packaging appears to be damaged on receipt, this must be noted with the courier and notified to Caffé Prima without delay.

Caffé Prima will replace any damaged items as necessary after discussion and confirmation.

When goods are signed for by the purchaser or appointed receiver, the customer inherits the risk for the products once they have been delivered to the delivery address which was specified when the order was placed.

Caffé Prima accepts no liability for non-delivery, late delivery or the cost of resending goods that have been delivered correctly to an incorrectly specified delivery address or where you fail to collect the products from the delivery address which you specified.

COLOURS & IMAGES 

Caffé Prima will endeavour to provide accurate images that represent the products for sale. Images are purely for illustrative purposes and packaging or product may differ from the image shown. Caffé Prima will accept no liability for any errors or omissions in this information.

The colour of goods or packaging may vary slightly from that shown on the Website due to limitations of browser software, photo and viewing monitor quality. Caffé Prima reserves the right to amend any designs or images without prior notice.

STOCK DATES (USE BY / SELL BY)

Caffé Prima strives to offer the best shelf life possible on all products. No product shipped will have less than 28 days to expiry unless otherwise stated explicitly on the product listings (exceptions can include fresh baked goods orpromotional short dated clearance stock). 

CONSUMER RIGHTS

None of these Terms and Conditions affects your statutory consumer rights.

CANCELLATIONS

You may cancel your order up until the point prior to the order being dispatched. This will depend on the time of day the order was placed. A typical cut off point would be by 15:00hrs on the day of order. It is in your interests to contact Caffé Prima as soon as you know the order is to be cancelled.

If an order is cancelled before dispatch, any payments (including delivery charges) made by you will be refunded in full.

If the order is cancelled after the goods have been dispatched it will be dealt with as a 'return'.  And you will be fully liable under the returns policy stated above.

REFUNDS ON RETURNED GOODS

For payments made by Debit or Credit card, refunds are automatically made directly back to the payment method used. For payments made through PayPal, refunds must be requested via PayPal. In other cases a credit note will be put against your account.

Orders paid for by cheque or cash will be refunded by Company cheque unless otherwise stated.

Such refunds may result in an admin fee of up to 5% depending on the amount to be refunded and the type of card used when purchasing the goods.

Please note there is a 15% handling charge on all returns (excepting faulty or damaged goods) as stated in the returns section above. 




SITE SECURITY

All areas on the Website are secure and at checkout, the Website uses SagePay and 3D secure for all credit card and debit card transactions. PayPal can also be used if you already have a PayPal account set up and active.

The Website has been enhanced to enable you to purchase our products online in a secure environment. We have a no-nonsense ordering system: simply make your purchases, and then pay at the checkout.

If however, you would prefer to arrange an order and pay over the telephone, you can do this by selecting the pay by phone function and a representative from Caffé Prima will call to take the order and associated payment. 

You do not have to register to use this site. 

PRIVACY 

Caffé Prima treats and handles your personal data confidentially and uses your personal information to provide the services you've requested through your preference settings (in the My Account area). We may also use this information for auditing, research and analysis to operate and improve our technologies and services.

Caffé Prima will never pass, share or sell your details on to any third parties.

VALIDITY 

Errors and Omissions Excepted (E&OE) – If Caffé Prima identify an incorrectly advertised price before or after an order is accepted, Caffé Prima reserve the right not to accept or process the order using the incorrect price.

Caffé Prima will always endeavour to display correct and accurate pricing and discounts. Prices are subject to change without notice. 

CURRENCY

All prices are in pounds sterling, exclude delivery charges and VAT where stated. The complete price for goods ordered including VAT and delivery charges will be clearly displayed prior to final checkout.

EXPORT

Caffé Prima are a UK based company and do not offer overseas shipping as standard. 

LINKS TO THIRD PARTY WEBSITES

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is generally for additional information only and is not intended to act as an endorsement of such websites and you acknowledge and agree that we are not responsible for the content, risk or availability of any such sites. 

COPYRIGHT

All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Caffé Prima or otherwise used by Caffé Prima as permitted by law. 

In accessing the Website, you agree that you will access the content solely for your personal or commercial use.

None of the Website content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder Caffé Prima. 

DISCLAIMERS AND LIMITATION OF LIABILITY 

The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. 

To the extent permitted by law, you indemnify directors, employees and suppliers of Caffé Prima not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website. 

Caffé Prima makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive. 

Nothing in these Terms and Conditions shall be construed to exclude or limit the liability of Caffé Prima for death or personal injury as a result of the negligence Caffé Prima or that of its employees or agents by using the Website. 

SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable. 

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
